{"id":13918,"date":"2024-02-13T17:25:31","date_gmt":"2024-02-13T22:25:31","guid":{"rendered":"https:\/\/www.guideimmo.ca\/articles\/?p=13918"},"modified":"2024-02-13T17:27:16","modified_gmt":"2024-02-13T22:27:16","slug":"un-projet-de-loi-au-detriment-du-bon-sens","status":"publish","type":"post","link":"https:\/\/www.guideimmo.ca\/articles\/un-projet-de-loi-au-detriment-du-bon-sens\/","title":{"rendered":"Un projet de loi au d\u00e9triment du bon sens?"},"content":{"rendered":"\n<p><strong>Le projet de loi Duranceau ravive les craintes de corruption dans le domaine de la construction<\/strong>. <strong>Ce projet de loi 31 en habitation, d\u00e9pos\u00e9 par la ministre de l&rsquo;Habitation du Qu\u00e9bec, France-\u00c9laine Duranceau, soul\u00e8ve des inqui\u00e9tudes quant \u00e0 sa propension \u00e0 favoriser la <a href=\"https:\/\/www.guideimmo.ca\/articles\/des-compagnies-erigees-sur-des-coquilles-vides\/\" target=\"_blank\" rel=\"noreferrer noopener\">corruption et la collusion dans le domaine de la construction<\/a>. L&rsquo;amendement 37.2, ajout\u00e9 en novembre dernier, permet aux municipalit\u00e9s de plus de 10 000 habitants, avec un taux d&rsquo;inoccupation inf\u00e9rieur \u00e0 3%, de d\u00e9roger \u00e0 leurs r\u00e8glements d&rsquo;<a href=\"https:\/\/www.guideimmo.ca\/articles\/laval-embrasse-la-modernite-en-adoptant-un-nouveau-code-de-lurbanisme\/\" target=\"_blank\" rel=\"noreferrer noopener\">urbanisme<\/a> pour acc\u00e9l\u00e9rer l&rsquo;autorisation de projets de construction r\u00e9sidentielle de trois logements ou plus. Cette permission sp\u00e9ciale s&rsquo;appliquerait pour une p\u00e9riode de cinq ans. <\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"604\" src=\"https:\/\/www.guideimmo.ca\/articles\/wp-content\/uploads\/2024\/02\/loi_duranceau_construction-1024x604.jpg\" alt=\"Le projet de loi Duranceau suscite des inqui\u00e9tudes \u00e9thiques parmi les experts, mettant en lumi\u00e8re les risques de corruption dans le secteur de la construction.\" class=\"wp-image-13931\" srcset=\"https:\/\/www.guideimmo.ca\/articles\/wp-content\/uploads\/2024\/02\/loi_duranceau_construction-1024x604.jpg 1024w, https:\/\/www.guideimmo.ca\/articles\/wp-content\/uploads\/2024\/02\/loi_duranceau_construction-300x177.jpg 300w, https:\/\/www.guideimmo.ca\/articles\/wp-content\/uploads\/2024\/02\/loi_duranceau_construction-150x89.jpg 150w, https:\/\/www.guideimmo.ca\/articles\/wp-content\/uploads\/2024\/02\/loi_duranceau_construction-768x453.jpg 768w, https:\/\/www.guideimmo.ca\/articles\/wp-content\/uploads\/2024\/02\/loi_duranceau_construction.jpg 1125w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>Des experts, dont la professeure de droit Martine Valois et le professeur en science politique Denis Saint-Martin de l&rsquo;Universit\u00e9 de Montr\u00e9al, redoutent que cette d\u00e9rogation cr\u00e9e un \u00ab pouvoir discr\u00e9tionnaire \u00bb excessif pour les \u00e9lus, ouvrant la voie \u00e0 des pratiques similaires \u00e0 celles examin\u00e9es par la Commission Charbonneau.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Les urbanistes et les architectes du Qu\u00e9bec sont s\u00e9rieusement pr\u00e9occup\u00e9s<\/h2>\n\n\n\n<p>L&rsquo;Ordre des urbanistes du Qu\u00e9bec et l&rsquo;Ordre des architectes du Qu\u00e9bec ont r\u00e9cemment exprim\u00e9 leurs pr\u00e9occupations quant aux risques de favoritisme et \u00e0 la politisation excessive des approbations dans une lettre adress\u00e9e \u00e0 la ministre Duranceau et \u00e0 d&rsquo;autres responsables gouvernementaux. Le pr\u00e9sident de l&rsquo;Ordre des urbanistes, Sylvain Gari\u00e9py, met en garde contre un possible \u00ab Far West \u00bb dans le processus d&rsquo;approbation des projets de construction, soulignant de s\u00e9rieux probl\u00e8mes \u00e9thiques. Les \u00e9lus auraient, selon lui, le loisir de favoriser certains constructeurs au d\u00e9triment d\u2019autres sans justification claire.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"604\" src=\"https:\/\/www.guideimmo.ca\/articles\/wp-content\/uploads\/2024\/02\/corruption_construction-1024x604.jpg\" alt=\"casque de construction\" class=\"wp-image-13932\" srcset=\"https:\/\/www.guideimmo.ca\/articles\/wp-content\/uploads\/2024\/02\/corruption_construction-1024x604.jpg 1024w, https:\/\/www.guideimmo.ca\/articles\/wp-content\/uploads\/2024\/02\/corruption_construction-300x177.jpg 300w, https:\/\/www.guideimmo.ca\/articles\/wp-content\/uploads\/2024\/02\/corruption_construction-150x89.jpg 150w, https:\/\/www.guideimmo.ca\/articles\/wp-content\/uploads\/2024\/02\/corruption_construction-768x453.jpg 768w, https:\/\/www.guideimmo.ca\/articles\/wp-content\/uploads\/2024\/02\/corruption_construction.jpg 1125w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>De plus, l&rsquo;amendement 37.2 entre en contradiction avec la Politique nationale de l&rsquo;architecture et de l&rsquo;am\u00e9nagement du territoire (PNAAT) de la ministre Laforest, d\u00e9noncent l&rsquo;Ordre des urbanistes du Qu\u00e9bec et l&rsquo;Ordre des architectes du Qu\u00e9bec. La PNAAT, d\u00e9voil\u00e9e en juin 2022 apr\u00e8s de nombreuses ann\u00e9es de travail et une consultation nationale, vise une planification urbaine plus coh\u00e9rente, limitant notamment l&rsquo;\u00e9talement urbain. Cette opposition soul\u00e8ve des interrogations. \u00ab On se dote d\u2019une politique et la premi\u00e8re chose que l\u2019on fait, on permet de contourner tous les outils d\u2019urbanisme et d\u2019am\u00e9nagement du territoire \u00bb, mentionne M. Gari\u00e9py. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Les experts proposent des solutions plus nuanc\u00e9es<\/h2>\n\n\n\n<p>Bien que la ministre Duranceau justifie cet amendement comme une mesure pour stimuler la construction dans le contexte de la <strong><a href=\"https:\/\/www.guideimmo.ca\/articles\/500-menages-sans-toit-la-crise-du-logement-saggrave\/\" target=\"_blank\" rel=\"noreferrer noopener\">crise du logement<\/a><\/strong>, certains experts remettent en question la transparence de cette approche. Le professeur en science politique de l\u2019UdeM, Denis Saint-Martin, appelle \u00e0 une compensation par davantage de transparence, sugg\u00e9rant que l&rsquo;Autorit\u00e9 des march\u00e9s publics (AMP) pourrait tenir un registre des municipalit\u00e9s b\u00e9n\u00e9ficiant de cette d\u00e9rogation.<\/p>\n\n\n\n<p>La professeure de droit, Martine Valois, propose  la possibilit\u00e9 pour le gouvernement de d\u00e9poser une loi sur l&rsquo;all\u00e8gement r\u00e9glementaire en mati\u00e8re de construction, avec des contre-pouvoirs et une structure assurant une prise de d\u00e9cision plus transparente pour contrer la corruption.<\/p>\n\n\n\n<p>L&rsquo;Ordre des urbanistes du Qu\u00e9bec et l&rsquo;Ordre des architectes du Qu\u00e9bec recommandent des mesures telles qu&rsquo;une strat\u00e9gie globale sur le logement et un signal clair du gouvernement en mati\u00e8re de \u00ab densification douce \u00bb.
